Terms of Service

1. Agreement Overview

These Terms of Service establish the agreement between you (the Client) and Banksia Portraits. By paying the booking fee or participating in a portrait session, you agree to the terms outlined below.

2. Booking and Payment

Booking Fee: A non-refundable booking fee is required to secure your session date and time in our calendar. Your session is not officially confirmed until this fee is received.

Balance: The remaining balance for your session and any selected packages is due prior to the delivery of your final high-resolution images.

Pricing: Rates are subject to change at our discretion, but the prices agreed upon at the time of your paid booking will be securely locked in.

3. Rescheduling and Cancellations

Rescheduling: We kindly request at least 48 hours' notice if you need to postpone your session. Your booking fee can be transferred to a new date on one occasion, subject to our availability.

Client Cancellations: If you choose to cancel your session entirely, the booking fee is forfeited to cover the lost booking opportunity.

Photographer Cancellation: In the rare event that Banksia Portraits is unable to photograph your session due to illness or unforeseen emergencies, all monies paid (including the booking fee) will be fully refunded, or a priority reschedule will be arranged.

4. Copyright and Usage Rights

Ownership: Banksia Portraits retains the primary copyright and ownership of all images captured during the session.

Personal Use License: Upon final payment, you are granted a non-exclusive, non-transferable license to use the delivered images for personal purposes. This includes printing for your home, sharing with family, and posting on personal social media accounts.

Restrictions: You agree not to sell the images, use them for commercial or financial gain, or apply heavy filters/edits that alter the original aesthetic of the provided photography.

5. Online Gallery and Delivery

Turnaround: Final, fully edited images will be delivered to you via a secure, private online gallery.

Storage and Archiving: The gallery will remain active for 30 days for you to view, favorite, and download your high-resolution files. Clients are entirely responsible for securely downloading and permanently backing up their own files within this timeframe. Banksia Portraits is not liable for storing images indefinitely after the gallery expires.

6. Governing Law

This agreement is governed by the laws of Victoria, Australia.
